Distance Selling Agreement

This Agreement regulates the terms and conditions of the distance sale between HACI KASIMOĞULLARI (“Seller”) and the person making purchases through our website (“Buyer”). Within the scope of Law No. 4077 on the Protection of Consumers and the relevant legislation, it sets out the rights and obligations of the parties.

Article 3 – Buyer Information

All natural or legal persons who create a membership or make purchases through hacikasimogullari.com shall hereinafter be referred to as the “Buyer”.

Article 4 – Subject of the Agreement and Product Information

  • Products or services are offered within the framework of the type, quantity, brand/model, color, quantity and sales price specified on the website.

  • The right to make changes regarding the products is reserved; in such cases, the Buyer may be informed.

Article 5 – General Provisions

  • The Buyer acknowledges that they have read and approved the basic characteristics of the product subject to the Agreement, its sales price, method of payment and delivery information.

  • The product subject to the Agreement shall be delivered within a period that does not exceed the legal 30-day time limit, varying according to the Buyer’s place of residence.

  • If the product is to be delivered to a person other than the Buyer, the Seller shall not be held responsible for that person’s refusal to accept the delivery.

  • For the Agreement to be valid, the price of the product must be paid.

  • In cases of unauthorized transactions regarding the credit card or cancellations arising from the bank, the Seller shall be deemed released from the obligation to deliver the product.

  • If delivery cannot be made due to force majeure (such as adverse weather conditions, interruptions in transportation, etc.), the Buyer may exercise their rights to cancel the order, postpone delivery or similar options.

  • The Buyer is deemed to have accepted the terms of this Agreement at the moment they create a membership or make a purchase.

Article 6 – Right of Withdrawal

  • The Buyer has the right of withdrawal within 7 days from the date they receive the product.

  • For the withdrawal request to be valid, the product must be unused, its packaging unopened and undamaged.

  • The return shipping cost shall be borne by the Buyer. Payments to be made within the scope of the right of withdrawal shall be processed by giving a refund instruction to the bank within 7 days after the product in question reaches the Seller.

Article 7 – Competent Court

In the implementation of this Agreement, up to the value announced by the Ministry of Industry and Trade, the Consumer Arbitration Committees, and above this limit, the Consumer Courts located in the place of residence of the Buyer or the Seller shall be competent.
